The Roblox-apple dance copyright battle is over!
Kelley Heyer v. Roblox! The apple dance copyright battle! It's over!
Remember, Heyer is the creator of the Charli XCX apple dance.
She sued Roblox, claiming that Roblox sold an emote of her copyrighted dance without her permission, and it made $120k on it.
Not so says Roblox! Roblox says they agreed to license it for $7,500.
It ended today. Heyer agreed to dismiss her lawsuit with prejudice.
What does that mean?
When a lawsuit is dismissed with prejudice, it means the plaintiff can never re-file the suit. That happens when the parties settle.
We don't know how much she received in the settlement (it's confidential), but I doubt she received much.
In fact, I bet the amount both sides paid in attorney fees was over 2x what she took home. There's a reason why people say the only winners in litigation are the lawyers. ๐
I also wonder if Roblox wanted this settled before RDC this week. Maybe the settlement involves a promise of future partnerships together.
