MeepCity Lawsuit: Is Alex Newtron on the Hook for Big Money?
Alex Newtron lost the MeepCity copyright lawsuit by default. Let’s talk about how much money Alex may have to pay.
Remember, this is the case where a musician alleged that Alex used his recording of a song without permission in the game.
First, losing a lawsuit by default is like a forfeit in sports—if your team doesn’t show up for the game, the other team wins without even playing.
But even though the musician won the case by default, he still needs to prove how much money he should get.
Lawyers call this his damages.
The musician is entitled to recover his actual damages. This is how much money the musician actually lost because of the infringement.
For example, the musician would have to prove that his sales of his song recording-or his streams of the song, dropped because of the infringement (and not because of some other reason).
It is hard for me to imagine that the use of the song in MeepCity caused the musician to lose any sales or streams.
That means his actual damages is probably close to zero. So Alex won’t have to pay any money. Or at least, the amount would be minimal.
But there’s another theory of damages that the musician can try to use. I’ll cover that next time.
